Complaints Procedure

In any dispute between members, and only after informal mediation has failed to satisfy one of the parties, or in any dispute between members and any other party, and only after informal mediation has failed to satisfy one of the parties, the following procedure shall be invoked.

1. A written deposition shall be sent to the Association’s Executive Committee, giving:
a) Specific details of the complaint, including all relevant dates and times.
b) Names and addresses of all parties involved.
c) Names and addresses of all relevant third parties/witnesses.
d) Reference to which article (if any) within the Associations’ Constitution or other published documents are believed to have been transgressed (copies of non-Association documents will be included).

2. Within two weeks of receiving the above deposition, the Executive Committee shall nominate a Disciplinary Committee with one independent (Non-Association) member, with powers to investigate the dispute, including interviewing all relevant parties and requesting any further documentation required. This Disciplinary Committee cannot include the contending parties themselves.

3. Within two weeks of receiving the above deposition, the Disciplinary Committee shall ensure that all relevant parties have received details of the complaint and notification of the Complaints and Disciplinary Procedure. The ‘defendant’ party/parties shall be invited to submit their own deposition, within a further two weeks, giving:
a) Specific details of the complaint, including all relevant dates and times.
b) Names and addresses of all parties involved.

4. Within seven weeks of receiving the original deposition, the Disciplinary Committee shall present a report to the Executive Committee, summarising the results of the investigation, with any relevant supporting documentation, and with any relevant recommendations.
c) Names and addresses of all relevant third parties/witnesses.
d) Reference to which article (if any) within the Association’s Constitution or other published documents are believed to have been transgressed (copies of non-Association documents to be included).

5. Within eight weeks of receiving the original deposition, the Executive Committee shall publish, and distribute to all interested parties, a judgement on the case and any possible subsequent up to, and including, revoking membership.

6. THE RESULT OF THIS JUDGEMENT SHALL BE FINAL.
